These Terms & Conditions ("Agreement") govern the use of services provided by PratimaaTech ("PratimaaTech", "we", "our", or "us") to any individual, business, or organization ("Client", "Customer", "you", or "your"). By engaging with our services, you acknowledge that you have read, understood, and agreed to these terms.
These terms apply to all website development, UI/UX design, digital marketing, graphic design, hosting, deployment, maintenance, AI integration, and other digital services provided by PratimaaTech.
1.1 "Client" means any individual, company, organization, or business requesting or purchasing services from PratimaaTech.
1.2 "Services" means the digital services provided by PratimaaTech, including website development, UI/UX design, digital marketing, graphic design, SEO, AI integrations, hosting, deployment, and technical support.
1.3 "Project" means the website, application, design, marketing campaign, software, or other digital work agreed upon between PratimaaTech and the Client.
1.4 "Content" means text, images, videos, logos, documents, product information, or any other material provided by the Client for use in the Project.
1.5 "Deliverables" means the final website, design files, graphics, source code, marketing materials, or other agreed work delivered by PratimaaTech.
1.6 "Third-Party Services" means external services or platforms such as hosting providers, payment gateways, APIs, Google services, social media platforms, AI tools, plugins, themes, or other third-party software.
2.1 Service Scope PratimaaTech will provide services according to the requirements discussed and agreed with the Client. The scope, features, functionality, number of pages, integrations, and deliverables may vary depending on the selected service or project package.
2.2 Project Changes Any major changes or additional features requested after approval of the project scope may require additional development time and charges. Such changes will be discussed with the Client before implementation.
2.3 Client Requirements The Client is responsible for providing accurate content, business information, images, credentials, product details, and other materials required to complete the Project.
3.1 Project Charges The total project cost will be based on the services, features, requirements, and scope agreed upon between PratimaaTech and the Client.
3.2 Advance Payment PratimaaTech may require an advance payment before beginning development or design work. Work may begin only after the agreed initial payment has been received.
3.3 Additional Work Features, pages, integrations, revisions, or services outside the agreed scope may be charged separately.
3.4 Payment Delays Delayed payments may result in temporary suspension of development, hosting, maintenance, or other services until outstanding payments are cleared.
4.1 Development PratimaaTech will develop websites and web applications according to the approved requirements, design, functionality, and technical specifications.
4.2 Delivery Timeline Project timelines depend on the size and complexity of the Project and the timely availability of content, feedback, approvals, and required information from the Client.
4.3 Testing Websites will be tested for general functionality and responsiveness before delivery. Compatibility with every possible browser, device, plugin, or third-party system cannot always be guaranteed.
5.1 Design Approval The Client is responsible for reviewing and approving designs, layouts, branding elements, and other visual materials before final development or production.
5.2 Revisions Revisions included in the selected package will be communicated before project completion. Significant redesigns or changes after approval may be treated as additional work.
6.1 Client Content The Client confirms that all text, images, logos, videos, documents, and other materials provided to PratimaaTech are legally owned or licensed for use.
6.2 Accuracy PratimaaTech is not responsible for errors, claims, or legal issues arising from inaccurate, misleading, or unauthorized content supplied by the Client.
7.1 External Platforms Projects may use third-party services including hosting providers, payment gateways, APIs, Google services, social media platforms, plugins, AI tools, and other external systems.
7.2 Third-Party Availability PratimaaTech is not responsible for downtime, pricing changes, service interruptions, policy changes, or technical issues caused by third-party platforms.
8.1 Domain & Hosting Domain registration, hosting, SSL certificates, email services, and other third-party services may involve separate charges depending on the Client's requirements.
8.2 Account Ownership Domain names, hosting accounts, email accounts, and third-party subscriptions should preferably be registered under the Client's ownership and credentials.
9.1 Marketing Services Digital marketing and SEO services are performed using industry-standard strategies and optimization techniques.
9.2 No Guaranteed Rankings PratimaaTech does not guarantee specific search engine rankings, traffic levels, leads, sales, or advertising results because these depend on search engines, competition, market conditions, budgets, and other external factors.
10.1 Client Ownership Upon receipt of the agreed full payment, ownership of the final custom deliverables created specifically for the Client will be transferred according to the project agreement.
10.2 Third-Party Materials Third-party libraries, plugins, fonts, stock images, themes, APIs, and other licensed materials remain subject to their respective licenses and terms.
PratimaaTech will take reasonable steps to protect confidential business information, login credentials, project information, and other sensitive materials shared by the Client during the course of the Project.
12.1 Post-Launch Support Support and maintenance services may be provided according to the selected package or separate maintenance agreement.
12.2 Additional Support Major feature changes, new pages, redesigns, server migration, or extensive bug fixing outside the agreed support period may be charged separately.
PratimaaTech will make reasonable efforts to provide reliable and professional services. However, we are not responsible for losses caused by third-party platforms, hosting failures, cyber attacks, unauthorized access, internet outages, or circumstances beyond our reasonable control.
Either party may request cancellation of a Project. Any refund or outstanding payment will be handled according to the agreed payment terms, work completed, and expenses already incurred.
By purchasing or using services provided by PratimaaTech, the Client confirms that they have read, understood, and accepted these Terms & Conditions. PratimaaTech reserves the right to update these terms when necessary to reflect changes in our services or business practices.
